The following privacy policy and terms of use outlines the types of information we gather when you visit our website(s), and steps we take to safeguard it.

Information Collection


When you use the Visit Oakland website, or participate in our sponsored programs, promotions, sweepstakes, games, raffles or contests, we collect information that you submit to us and via “cookies” and other technologies as described below.

We collect information in several ways from different parts of our website(s). We do not collect personal information about you when you visit our website unless you choose to provide that information to us. We collect limited non-personally identifying information your browser makes available automatically whenever you visit a website. This information includes the internet address of your computer or network, the date, time, and page you visited on our site, your browser and operating system, and the referring page (the last webpage you visited before clicking on a link to our site).

We use the aggregated information from all of our visitors to measure server performance, analyze user traffic patterns and improve the content of our site. We sometimes track the keywords that are entered into our search engine to measure interest in specific topics, but we do not track which terms a particular user enters.

If you, agree, we will be using your e-mail address to provide you with information we think you will be interested in, for example, to send you our newsletters, notify you of new publications, or inform you about updates to our website. You can let us know at any time if you would prefer not to receive any or all of this information either directly on our website or by sending an e-mail to visit@visitoakland.com.

By submitting information to us, you consent to its collection and use by us in accordance with this Privacy Policy. Users have the option of discontinuing participation in our mailing lists or programs, or editing their personally identifiable information by contacting us. (See “Opt-in/Opt-out,” below.)

Contest/Sweepstakes Information 


Participation in contests, sweepstakes, raffles, games or similar promotions sponsored by Visit Oakland or by third parties also requires the disclosure of personally identifiable information. We may share that information with third-party sponsors of the contests, sweepstakes, raffles, games or similar promotions. This information is subject to usage outlined in “Information Collection,” above. In addition, you should carefully review the rules of each contest, sweepstakes, raffle, game or similar promotion in which you participate. The extent that the terms and conditions of those rules concerning treatment of your personally identifiable information conflict with this Privacy Policy, the terms and conditions of those rules will control.

Online Services and RFP Forms

Some of the online services available with our website(s) require you to register for an account or provide personal information. You will be asked for applicable information to create an account, including name, email address and a preferred password for your account. We do not give, share, sell, rent or transfer any personal information to a third party, unless we have your consent.

If you would like us to delete all of your personal information (except for information that we keep for record-keeping purposes) and/or remove your name and address from promotional lists (including any personal information gathered by our service providers) and place your name on our “do not contact” list, you should contact our Privacy Administrator at visit@visitoakland.com. Please note that any requests to update your personal information may take up to 30 days for an email request and six weeks to process a postal-mail request.

Cookies


To help us serve you better, we collect information that does not identify you personally, but rather identifies your computer or browser. Cookies are pieces of information placed in the settings of your web browser by a website server to identify your computer when you return to a website. Whenever a site welcomes you and tailors data to your specifications, it is reading a cookie left in your browser and identifying information that you may have registered during previous visits, such as your viewing preferences.

We may use cookies and other technologies to keep track of your status as a participant in our promotions, to tailor information to your preferences, or for other similar purposes. Users may opt out of receiving interest-based advertising by advertising networks that may be delivered to them on our platform and other websites by visiting the following website: optout.aboutads.info  This site feature will opt a visitor out of many – but not all - of the interest-based advertising activities in which we or third parties engage.

Do Not Track Policy


Visit Oakland’s website currently does not respond to “do not track” signals or other mechanisms that provide consumers a choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third party online services.

Disclosure for Legal Purposes 


We may be required to share your personally identifiable information and non-personally identifiable information pursuant to judicial or governmental subpoenas, warrants or orders. If we are legally required to do so, or, in good faith believe that we are legally required to do so, we will obey the law. In addition, we reserve the right to use, disclose and share your personal and non-personal information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or as otherwise required by law.

Disclaimer Concerning Third Parties 


We may provide certain personally identifiable information to our partners. Furthermore, we may retain other companies and individuals to perform functions on our behalf. Examples include financial institutions, consumer e-mail service providers, web data tracking specialists and reservation booking engines. Such third parties may be provided with access to personally identifiable information needed to perform their functions, but may not use such information for any other purpose.

While we strive to protect your non-public personal information, we cannot guarantee the security of any information you transmit to us or receive from us. This is especially true for information you transmit to us via e-mail. We have no way of protecting that information until it reaches us. Correspondence


We maintain and review e-mail correspondence that you send to us. We may use (and maintain in a file specific to you) the personally identifiable information disclosed in the e-mail. Because such correspondence contains information that is not transmitted through the operation of the Site, it is not subject to the terms of this Policy.

Social Media


If you have made public posts from your other social media accounts that include our specialized hashtags, we may collect and use that information to learn more about you.

Minors Policy


Our online services are not directed toward persons under the age of 18, and we request that persons under the age of 18 not provide personally identifiable information to us.

GDPR


Visit Oakland makes commercially reasonable efforts to comply with all international laws, including the General Data Protection Regulations (GDPR). If you wish to access or amend any personal data we hold about you, or to request that we delete or transfer any information about you that we have obtained through our website or digital platforms, you may contact us at visit@visitoakland.com with the subject line “GDPR compliance”. At your request, we will have any reference to you deleted or blocked in our database. Please note that while any changes you make will be reflected in active user databases within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. At any time, you may object to the processing of your Personal Data, on legitimate grounds, except if otherwise permitted by applicable law. If you believe your right to privacy granted by applicable data protection laws has been infringed upon, please contact us at visit@visitoakland.com. You also have a right to lodge a complaint with data protection authorities. This provision does not apply to personal data that is part of our B2B client database. In this case, the management of our client data is subject to the terms of service for our business division and request for access, correction or deletion should be made to the account manager responsible for maintaining your client relationship.

Opt-In/Opt-Out 


You may choose to remove yourself from our mailing list by following the instructions stated on our promotional communications, by completing our online Feedback Form or by sending a request to our Customer Support. (See “Contact Us,” below.)

Policy Changes


We reserve the right, at its sole discretion, to change, modify, add or remove any portion of this Agreement, in whole or in part, at any time. Modification of changes in the Agreement will be posted on the website. By using this website you agree to be bound by any such revisions and should therefore periodically visit the page to determine the then current terms of use to which you are bound.
